These Terms of Service ("Terms") govern your use of the website operated by Complete Aquatic Solutions ("Company," "we," "our," or "us") at casarizona.com (the "Site"), and the pool services we provide. By accessing our website, requesting a quote, scheduling service, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
1. Scope of Services
Complete Aquatic Solutions provides the following services to both commercial and residential customers in Queen Creek, Arizona and the surrounding East Valley area:
- Commercial Pool Service: Weekly and scheduled maintenance for HOA pools, apartment complexes, hotels, community pools, and commercial aquatic facilities, including compliance inspections and chemical management.
- Residential Pool Service: Routine pool cleaning, maintenance, and water chemistry balancing for homeowners.
- Pool Repair: Diagnosis and repair of pool pumps, filters, heaters, salt systems, automation systems, valves, plumbing, and other pool equipment.
- Equipment Installation: Installation and replacement of pool pumps, filters, heaters, chlorinators, automation controllers, and related equipment.
- Virtual Pool Technician: Remote video-call consultations for equipment troubleshooting, repair guidance, second opinions, and pool design advice, available nationwide.
- Green Pool Recovery & Specialty Services: Algae treatment, stain removal, acid washing, and equipment upgrades.
On-site service availability is limited to our service area in the East Valley of Arizona. Virtual consultation services are available nationwide. All services are subject to technician availability, weather conditions, and site accessibility.
2. Service Agreements & Payment Terms
By requesting a service quote or scheduling an appointment, you acknowledge the following payment and invoicing terms:
- Authorization: All service work requires either a signed service agreement or explicit verbal or written authorization before commencement.
- Payment Due: Payment is due upon completion of service unless a monthly billing arrangement has been established. Commercial accounts may be set up with net-15 or net-30 terms by prior agreement.
- Invoicing: Invoices are issued via QuickBooks and may be delivered by email or text message. Invoices are due within the stated terms; late payments may incur a reasonable late fee.
- Estimates: Estimates are provided in good faith based on visible conditions. Final costs may vary based on actual conditions discovered on-site. You will be notified of any material change before additional work is performed.
- Accepted Payment Methods: We accept cash, check, and major credit cards (Visa, Mastercard, American Express, Discover) processed through QuickBooks.
- Parts & Materials: The cost of parts, materials, and equipment is billed in addition to labor unless otherwise stated in your quote.
- Service Agreements: Recurring service customers are bound by the terms of their signed service agreement, which may supplement but not contradict these Terms.
3. Liability Disclaimer
Important: Complete Aquatic Solutions is not liable for pre-existing conditions, structural issues, or underground lines discovered during the course of our work.
- Pre-Existing Conditions: We are not responsible for damage or issues caused by pre-existing conditions, including but not limited to prior improper repairs, aging equipment, deteriorated plumbing, or structural defects that existed before our service.
- Structural Issues: We are not liable for structural problems with your pool, deck, surrounding surfaces, or supporting structures, including cracking, settling, heaving, or water loss unrelated to our work.
- Underground Lines: We are not liable for damage to underground lines (electrical, gas, water, plumbing, irrigation, or otherwise) discovered during excavation, trenching, or equipment installation. It is the property owner's responsibility to identify and mark underground utilities before work begins. We recommend calling 811 (Arizona Blue Stake) prior to any digging.
- Hidden Conditions: If hidden conditions are discovered during work that were not apparent at the time of estimate, we will notify you before proceeding. You are responsible for any additional costs associated with addressing such conditions if you authorize the work.
- Manufacturer Defects: We are not liable for defects in materials or equipment manufactured by third parties. Manufacturer warranties apply to their products separately from our services.
4. AI Assistant Disclaimer
Our website features an AI-powered pool technician assistant ("Billy") that provides automated responses for informational and educational purposes only.
- Informational Only: Billy's responses are provided for informational purposes only and are not a substitute for diagnosis or service by a licensed professional. AI-generated advice may not account for all variables specific to your pool, equipment, or local code requirements.
- Electrical, Gas & Hazardous Systems: AI advice must never be relied upon for work involving electrical systems, gas lines, pressurized systems, or other hazardous conditions. Always consult a licensed electrician, gas professional, or qualified pool technician for such work.
- No Warranty: We make no warranty that AI-generated information is accurate, complete, current, or suitable for your specific situation.
- Indemnification for AI Reliance: By using our AI assistant, you acknowledge that any reliance on AI-generated information is at your own risk. You agree to indemnify and hold harmless Complete Aquatic Solutions, its owners, employees, and contractors from any claims, damages, losses, or liabilities arising from your use of or reliance on AI-generated advice, including but not limited to property damage, personal injury, or equipment failure resulting from acting on AI recommendations without professional verification.
- Verify Before Acting: Always verify critical information with a qualified technician before undertaking significant repairs, equipment replacements, or any work involving safety hazards.
5. DIY Content & Educational Materials
The DIY guides, repair instructions, manuals, videos, and other educational content on our website are provided for informational purposes only. While we strive for accuracy, Complete Aquatic Solutions makes no warranty that this content is error-free, complete, or suitable for your specific equipment or situation. Always follow manufacturer instructions and consult a licensed professional when in doubt. We are not liable for any damage, injury, or loss resulting from attempting repairs based on our content.
6. Virtual Consultation Services
Virtual pool technician consultations are advisory in nature. Our technicians provide guidance based on information and images you provide. Virtual consultations do not substitute for an in-person inspection. Recommendations made during virtual sessions are based on what is visible or described and may be subject to revision upon physical inspection. We are not liable for outcomes resulting from following virtual consultation advice without professional on-site verification.
7. Limitation of Liability
To the fullest extent permitted by law, Complete Aquatic Solutions, its owners, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website, services, AI assistant, or educational content. Our total liability for any claim related to our services shall not exceed the amount actually paid by you to us for the specific service giving rise to the claim. This limitation applies regardless of the legal theory of recovery.
8. Indemnification
You agree to indemnify, defend, and hold harmless Complete Aquatic Solutions, its owners, officers, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of our website, services, or AI assistant
- Your reliance on AI-generated information or DIY educational content
- Your violation of these Terms or any applicable law
- Any inaccurate or misleading information you provide to us
- Any work you perform yourself based on our guidance without professional verification
This indemnification obligation survives the termination of your use of our website and services.
9. Cancellation & Rescheduling Policy
- Notice Required: Cancellations or rescheduling must be made at least 24 hours before the scheduled appointment time.
- Cancellation Fee: Appointments cancelled with less than 24 hours' notice may be subject to a cancellation fee of up to $75.00.
- No-Show: If a technician arrives at the scheduled time and is unable to access the pool or property, a trip charge may apply.
- Weather Cancellations: We reserve the right to reschedule service due to severe weather, lightning, or unsafe working conditions at no additional cost to you.
- Recurring Service: Recurring service customers must provide 30 days' written notice to cancel a service agreement.
- How to Cancel: To cancel or reschedule, call us at (480) 984-0300 or reply to your appointment confirmation text or email.
10. Text Messaging Terms
SMS messaging program: By opting in to receive text messages from Complete Aquatic Solutions, you agree to receive account-related and customer-care messages (for example: responses to your inquiries, scheduling, and follow-ups) at the phone number you provided. Message frequency may vary. Message and data rates may apply. Reply STOP at any time to unsubscribe; after you send STOP, we will confirm your opt-out and send no further messages. Reply HELP for help, or contact us at jeff@casarizona.com. Carriers are not liable for delayed or undelivered messages.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Maricopa County or Pinal County, Arizona, and you consent to the personal jurisdiction of such courts.
12. Dispute Resolution
In the event of any dispute arising out of or relating to these Terms or our services, the parties agree to the following resolution process:
- Informal Resolution: The parties shall first attempt to resolve the dispute through good-faith negotiations within 30 days of written notice of the dispute.
- Mediation: If informal resolution is unsuccessful, the parties agree to participate in non-binding mediation administered by a mutually agreed-upon mediator in Arizona before pursuing further legal action.
- Binding Arbitration: If mediation fails, the dispute shall be resolved by binding arbitration administered in Arizona under the applicable rules of the American Arbitration Association. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
- Class Action Waiver: Any dispute will be resolved on an individual basis; you waive any right to participate in a class action lawsuit or class-wide arbitration.
- Exception: Either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information without first exhausting the above process.
13. Intellectual Property
All content on this website, including text, images, logos, guides, videos, manuals, and the overall design, is the property of Complete Aquatic Solutions or its content suppliers and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from our content without prior written permission.
14. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. We will update the "Effective Date" at the top of this page. Your continued use of the site or our services after any changes constitutes acceptance of the new Terms.
